Ganesh Prasad is not talking about capitalism and that article is wrong from any economic perspective.
But yes, you can say that any FOSS license is a formal version of aspects of scientific ethics and rest is a matter of reasoned opinion.
My opinion was about the space of possible business models....I will need to write it in more detail.
