U have to be concerned. Without a licenced encoder u could be looking at fat liabilities.
Only concerns are that when I upload those, they should choke the bandwidths of the people trying to view it, and they should be able to view it.
That would depend on the bitrate and resolution settings. Currently MPEG4 is the best and vlc can stream and en/decode that very well. Theora is not as good. For high resolution high bitrate streams Dirac (gpl by BBC) is particularly good but experimental right now.

Yes they will require the theora codec available at http://xiph.org/ theora/
Otoh u can use vlc/ffmpeg to create mpeg4 streams, although mpg4 is encumbered for commercial use.
