OpenLX is GNU-GPL Licensed and hence free for download, use, sharing, etc... The Media is sold at very reasonable prices (www.openlx.com/products.html) for those who chose to get it ready. Support is on paid basis, depending on what one wants. There is no per-seat / per-copy / per-user license.

OpenLX is based on RPMs. Updates will soon be available from website. And, yes, the basic desktop version can be upgraded to the Server version (from website, once available) and also from the Server version media itself. Smart package manager is configured for this purpose.

heard it was based on/fork of centos. If so is it a fork or do you follow the centos upgrade path? Is the full source available for download?

rpm == fork of centos or fork of redhat - unless you built the whole thing from scratch. A centos develo had told me that it looked like a centos clone

Openlx has only a ISO download - there is no mention anywhere of any offer of source code, so it is not GPL software and the mention of GPL should be removed as that is a misrepresentation. And if it is based on some other GPL'd distro, then it is also guilty of GPL violation.

nice FUD there..
GPL doesn't mention that the source be freely available as a *download*.. however it *must* be provided on request / demand and you *CAN* charge a reasonable amount for media/shipping if you cannot host the source. If the GPL license is included with a distro (binary), then you *can* ask the distributer for the source and he/she ought to oblige.
From the fine gnu general public license: You may charge a fee for the physical act of transferring a copy, and you may at your option offer warranty protection in exchange for a fee.

your standards are obviously different from mine. But when a product is pushed as GPL and Open Source and heavily recommended on this list, blah blah - without putting up the source code even 2 years after release, I tend to be highly suspicious about the freeness and opensoureceness of the product. If you want to see what I consider a genuine free and opensource distro look here:
http://www.pardus.org.tr/eng/index.html
note the elaborate pages regarding source, developers, how developers should approach the source etc. Check this:
http://www.pardus.org.tr/eng/documents/developer/new_developer.html
ok - in hairsplitting legalistic terms I am being unreasonable, but would warn any users that the lack of transparency here may lead to problems tomorrow.

Again (and you know this), they do not have to put up the source code publicly.. but only provide it to someone who has downloaded / received the binary product. Download their ISO and push them for the source to the brink of their being suicidal.

Agreed.. and if you do not get a satisfactory response and commitment from openlx (preferably through a private communication) then kindly enlighten the rest of us.. who then ought to give them some nice *unwanted* publicity..

Perhaps the response could have been worded more diplomatically, but legally, the question remains valid: people should be prepared to provide the source as soon as the binaries are published. An I correct in my understanding that the binaries have been around for more than a few weeks now? If so, I do believe that there might be copyright violation in progress (what Miscrosoft terms software piracy); and for Debian derived distributions, I am an injured party, and would appreciate knowing the answer.

The usual digging a deep hole before diving into it. I find the contortions that the commercial distros undergo to get a customer locked in thoroughly amusing. If only they spend half the effort in actually improving support (to be read as actually following the spirit of the gpl.). Or be upfront about payed support. If anything they should be offering the code and charging for the binary which is a pain in the ass to compile and maintain.

The distributer is not obliged to reply for such requests on a public forum, however a private mail ought to be fine (not that the GPL mentions this).. and of course you are free to post the vendor's private response on a public forum.
In the event the vendor doesn't oblige, see this: http://www.gnu.org/licenses/gpl-violation.html
